1. Using this site

You may use this site to browse our products and place orders for your own use or, if you hold a wholesale account with us, for resale under the terms of that account. By placing an order you confirm that you are at least 18 years old, or that you are using the site with the involvement of a parent or guardian.

You agree not to use this site for any unlawful purpose, not to attempt to gain unauthorized access to any part of it, and not to interfere with its normal operation.

2. Products and descriptions

We do our best to describe and photograph our products accurately. Our Maya products are made from hand-woven cotton, which means that pattern placement and shading vary slightly from piece to piece. This is a characteristic of the material, not a defect. Colors may also appear differently depending on your screen.

3. Availability

All orders are subject to product availability. Our patterns and materials depend on our suppliers, and some items are made in limited runs. If an item you ordered is unavailable, we will contact you to arrange a substitution, a backorder or a refund. We reserve the right to limit quantities or to discontinue any product at any time.

4. Pricing and errors

Prices are shown in U.S. dollars and may change without notice. We make every effort to keep pricing and product information accurate, but errors occasionally occur. If an item is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed for that item, including after an order confirmation has been sent. If your order is cancelled for this reason and you have already been charged, we will issue a full refund.

5. Orders and payment

Submitting an order is an offer to buy. Your order is accepted when we confirm it and begin processing it. We reserve the right to refuse or cancel any order, including where we suspect fraud, where the order violates these terms, or where a product is unavailable.

Payment is due in full at the time of order. By submitting payment information you confirm that you are authorized to use the payment method provided.

6. Sales tax

Applicable sales tax is calculated at checkout based on your shipping address and the jurisdictions in which we are required to collect it.

7. Shipping and delivery

Orders are processed within 72 hours of receipt, and we aim to have all orders shipped within 3 to 5 business days, not including weekends and holidays. These are targets, not guarantees. Occasional delays happen, particularly during busy periods or when an item needs to be made to order.

Delivery times after shipment are determined by the carrier and are outside our control. We are not responsible for carrier delays, nor for packages that are delayed, lost or stolen after delivery has been confirmed by the carrier. If a shipment goes astray, contact us and we will help you pursue it with the carrier.

Risk of loss passes to you when the carrier takes possession of your order. Please make sure your shipping address is correct at checkout. We cannot be responsible for orders sent to an address entered incorrectly.

8. Returns, refunds and warranty

Returns, refunds and warranty claims are governed by our Refund and Returns Policy, which forms part of these terms. In summary: we offer a limited lifetime warranty against defects in materials and workmanship, and we handle returns and refunds on a case-by-case basis. Contact info@colorpet.com to start a claim.

9. Product use and pet safety

Our products are pet accessories, not restraint or safety devices. Collars, leashes and harnesses should be fitted correctly, checked regularly for wear, and never left on an unsupervised pet. Do not use a collar or harness as a tie-out, tether or anchor point. Do not leave a collar on a pet in a crate or kennel unattended. You are responsible for supervising your pet and for choosing equipment appropriate to your pet’s size, strength and behavior.

10. Accounts

If you create a customer or wholesale account, you are responsible for keeping your password confidential and for all activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission. We may suspend or close an account that is used in breach of these terms.

11. Intellectual property

All content on this site, including text, product photography, graphics, logos and the Color Pet Products and Maya names, is our property or is used with permission, and is protected by copyright and trademark law. You may not copy, reproduce or use it commercially without our written permission. Nothing on this site grants you a license to use our trademarks.

12. Links to other sites

This site may link to third-party websites. We provide those links for convenience only. We do not control those sites and are not responsible for their content, products or privacy practices.

13. Privacy

Your use of this site is also governed by our Privacy Policy, which forms part of these terms.

14. Disclaimer

Except for the limited lifetime warranty described in our Refund and Returns Policy, this site and our products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. We do not warrant that this site will be uninterrupted or error-free.

15. Limitation of liability

To the fullest extent permitted by law, Color Pet Products will not be liable for any indirect, incidental, special or consequential damages arising out of your use of this site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Color Pet Products and its owners and employees from any claim or demand arising out of your breach of these terms or your misuse of our products or this site.

17. Changes to these terms

We may update these terms from time to time. The version in effect at the time you place an order is the version that applies to that order. Changes take effect when posted on this page, and the date at the top will be updated.

18. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of these terms or your use of this site will be brought in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts.

19. Severability

If any part of these terms is found to be unenforceable, the rest of the terms remain in full effect.
